MCA grants permission to ROC to file complaint against CA/CS

If someone wishes to file a complaint against an auditor in India, they can do so by following these steps:
- Gather evidence: The complainant must gather all the necessary documents and evidence that support their complaint against the auditor.
- Contact the Institute of Chartered Accountants of India (ICAI): The ICAI is the regulatory body that governs the conduct of auditors in India. The complainant can contact the ICAI and file a complaint against the auditor. The complaint can be filed either online or offline and must include all the necessary details and evidence.
- Wait for an investigation: The ICAI will investigate the complaint and take appropriate action against the auditor if they find any wrongdoing. The investigation process may take some time, and the complainant must be patient during this period.
- File a case in court: If the complainant is not satisfied with the action taken by the ICAI, they can file a case in court against the auditor for any financial losses incurred due to the auditor's negligence or misconduct.
If you can amicably resolve the matter with CA it will be a good step. However, no CA would want to have a complaint filed against them which will impact Reputation and Goodwill.
